Compassion in World Farming is taking the Scottish Government to court. We’re challenging the appalling live export of young calves – and we need your help.

Every year, thousands of unweaned calves – often just a few weeks old – are sent from Scotland to fattening farms in Spain. These vulnerable, young ‘by products’ of the dairy industry suffer journeys that are both horrific and, we believe, illegal.

We’ve launched a Judicial Review at the Scottish Court of Session. Our aim is a ruling that, because calves can’t be fed on trucks, it is unlawful for the Scottish Government to permit unweaned calves to be transported for more than 8 hours.

If we win, exporting calves from Britain would become impossible in its current form – and thousands of animals every year could be spared these torturous journeys.

Stuck on a truck

Animal transport law states that unweaned calves cannot travel for more than 8 hours – unless, after a maximum of 9 hours’ transport, they are rested, given water and, “if necessary”, fed.

In reality, the ‘rest’ usually just means the lorry stops moving for an hour. And, because milk substitute can’t in practice be provided on the trucks, calves may go as long as 23 hours without food. They must be stressed, exhausted, and desperately hungry.

Whilst they’re on British farms, these young animals must legally be fed twice a day. Yet the transporters think it’s not ‘necessary’ to feed them until they’re first unloaded in Northern France!

Taking live exports to court

Compassion, and other campaigners, have written repeatedly to Scottish Ministers about calf export cruelty. Meanwhile, Members of the Scottish Parliament from most political parties have called for an end to live exports. And a Compassion poll showed that the majority of the Scottish public do not support this awful trade.

Yet, Scottish Ministers have, time and again, defended live exports. They’ve claimed a ban would harm Scotland’s livestock sector. They’ve even cited the fact that it “is not practical” to feed calves on trucks as a justification for current practices. This is simply unacceptable. So, we’re taking legal action.

Government hypocrisy

The success – indeed, even the completion – of our Judicial Review is, sadly, not guaranteed.

Our application has been accepted by the courts. And we won a big victory in June, when they rejected an outrageous application by the Scottish Government for an indefinite delay to the case. But, there is still a long way to go before the expected hearing in the autumn.

Meanwhile, at taxpayers’ expense, the Scottish Government has hired costly lawyers to fight their side. And, what is more, Westminster has weighed-in behind the live export trade.

The UK Government made a manifesto commitment to end ‘excessively long journeys’ of farm animals for slaughter and fattening. Yet, the Department for Food, Environment and Rural Affairs has appointed a leading lawyer to fight against our case.

In short, the UK Government is taking legal steps to protect a trade it claims to want to end. This hypocrisy is astonishing. And, sadly, this adds to the risk that Compassion’s costs for this legal action could escalate to the stage where we simply can’t continue the case. But, until that point, we will fight on.

  • We will force politicians to expose their ruthlessness and duplicity, as they try to defend the indefensible.
  • We will take this battle to the media – calling out the disregard of elected representatives for animal welfare and public opinion.
  • And we will rally compassionate people across the UK behind the message that exporting unweaned calves isn’t just morally wrong – it is illegal.
